Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Musical Memories mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Musical Memories ("we," "our," or "us"). Your continued use of the App following any updates to these Terms signifies your acceptance of the modified Terms.

2. Description of Service

Musical Memories is an AI-powered music discovery application designed to help users rediscover nostalgic songs from their past. The App provides the following services:

• Personalized song recommendations based on your birth year, location, and preferred time period
• AI-generated music suggestions powered by Google Gemini
• YouTube video integration for listening to recommended songs
• Playlist creation and management for saving your favorite discoveries
• Listening history tracking to improve recommendations and avoid repetition

The App is intended primarily for elderly users seeking to reconnect with music from their childhood and youth.

3. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

We reserve the right to terminate accounts or refuse service to anyone who does not meet these eligibility requirements.

4. Subscription and Pricing

Free Tier: New users receive 5 free song discovery searches. After exhausting these free searches, a subscription is required to continue using the search functionality.

Premium Subscription:

• Price: $1.00 USD per month (or equivalent in local currency)
• Billing: Subscriptions are billed through Google Play Store (Android) or Apple App Store (iOS)
• Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Cancellation: You may cancel your subscription at any time through your app store account settings. Cancellation takes effect at the end of the current billing period
• Refunds: Refunds for partial subscription periods are not provided. All refund requests are subject to app store policies

We reserve the right to modify subscription pricing with reasonable notice to existing subscribers.

5. User Responsibilities

By using the App, you agree to:

• Provide Accurate Information: You agree to provide truthful and accurate information when using the App, including your birth year and location data
• Personal Use Only: The App is for personal, non-commercial use only. You may not use the App for any business or commercial purposes
• No Reverse Engineering: You agree not to reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• No Illegal Use: You agree not to use the App for any illegal purpose or in violation of any applicable laws or regulations
• Account Security: If you create an account, you are responsible for maintaining the confidentiality of your login credentials
• Respect Content Rights: You acknowledge that music and videos accessed through the App are protected by copyright and agree not to download, copy, or redistribute such content

6. Intellectual Property

Our Property: The Musical Memories App, including its design, code, features, graphics, and user interface, is owned by Musical Memories and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes.

Third-Party Content: Music, videos, and other media content accessed through the App belong to their respective copyright holders. We do not claim ownership of any music or video content. All such content is provided through YouTube's embedded player and is subject to YouTube's Terms of Service.

You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent.

7. Third-Party Services

The App integrates with the following third-party services, each governed by their own terms and privacy policies:

• Google Gemini AI: Powers our song recommendation engine. Subject to Google's Terms of Service and AI Principles
• YouTube / YouTube Data API: Provides video search and playback functionality. By using Musical Memories, you agree to be bound by the YouTube Terms of Service. YouTube API Services are also governed by the Google Privacy Policy
• Google Analytics: Used for anonymous usage analytics to improve the App. Subject to Google's Terms of Service
• Supabase: Provides authentication and data storage services. Subject to Supabase Terms of Service
• Google Play Store / Apple App Store: Handles subscription billing and app distribution

We are not responsible for the content, policies, or practices of any third-party services. Your use of these services is at your own risk.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of AI-generated recommendations
• Warranties that all songs or videos will be available or embeddable

Song availability depends on YouTube's content policies and regional restrictions. We do not guarantee that any specific song will be available in your region or that recommendations will match your preferences.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MUSICAL MEMORIES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages arising from your use of or inability to use the App
• Any damages arising from unauthorized access to or alteration of your data
• Any damages arising from third-party services or content accessed through the App

In no event shall our total liability exceed the amount you have paid us in the twelve (12) months preceding the claim, or $12.00 USD, whichever is greater.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Non-payment of subscription fees
• Conduct that we determine to be harmful to other users or to the App

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Israel. You agree to submit to the personal jurisdiction of such courts.

12. Changes to Terms

We may update these Terms of Service from time to time to reflect changes in our practices, technology, legal requirements, or for other reasons. When we make material changes:

• We will update the "Last Updated" date at the top of these Terms
• We may notify you through the App or via email if you have an account
• Material changes will not apply retroactively

Your continued use of the App after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue use of the App.
